BTS RM's Privacy Invader Reinstated by Central Labor Commission — Details Inside

In a surprising turn of events, the Central Labor Relations Commission has ordered the reinstatement of an employee at the Korea Railroad Corporation (KORAIL) who was dismissed for unauthorized access to BTS RM's personal information. The decision comes after two retrials and has sparked debates over privacy concerns.

Unauthorized Access to RM's Personal Information

On December 22nd, Dispatch reported that the office of Kim Doo-gwan, a member of the Democratic Party of Korea, released the Central Labor Relations Commission's retrial decision submitted by KORAIL. The commission not only ordered the reinstatement of the dismissed employee, referred to as Mr. A, but also mandated the payment of normal wages.

Mr. A, formerly in charge of information technology development at KORAIL, had accessed RM's personal information for three years, starting in 2019. The unauthorized access included sensitive details such as ticket information, addresses, and mobile phone numbers.

Privacy Concerns and Legal Implications

The incident raised eyebrows as it violated Article 3 of the Personal Information Protection Act, which stipulates that customer personal information should only be used for the purpose of processing and must not be accessed for reasons other than business purposes.

KORAIL discovered Mr. A's misconduct during an internal audit, revealing that he had not only breached RM's privacy but had also accessed the personal information of other employees without permission. This led to his dismissal in April.

Controversial Reinstatement Decision

Despite the serious nature of the privacy violation, Mr. A contested his dismissal. The initial retrial application was dismissed, reflecting the severity of the allegations. However, in a surprising twist, the Central Labor Relations Commission overturned the decision in the final review, leading to Mr. A's reinstatement.

This controversial decision has sparked concerns among the public and within the industry about the protection of personal information and the consequences for those found guilty of unauthorized access.
