Lindsay Lohan Late To Rehab, Missed Flight, Must Arrive On Time Or Court Could Arrest Her; Resisting Rehab Because She "Can't Smoke"[VIDEO]

Lindsay Lohan is late checking into rehab and she's cutting it really close. If Lindsay isn't at the rehab facility on time the troubled star will have a lot more legal problems on her hands than she currently has.

Lindsay Lohan is required to show proof of enrollment in a live-in treatment program by 8:30 a.m, Thursday and sources say that as of early this morning she has STILL  not landed back in LA.

Lindsay was planning to check into Morningside Recovery Center in Newport Beach, Calif., but missed her initially scheduled flight from New York to L.A. Then she even showed up super late for her cross-country flight on a friend's private plane. LiLo, get it together!

"Her lawyer needs to walk into a courtroom at 8:30 a.m. with documentation that Lindsay is in some lockdown residential treatment program. The judge is going to need to see some kind of documentation that this is a licensed rehab facility that complies with some recognized legal credentialing agency."

If her attorney Mark Heller is not holding such a document the judge could easily revoke her probation, and order her to appear in court, putting out a warrant for her arrest.

No word yet if Lindsay has made the buzzer, but news will break shortly.

Lohan has been reluctant about going to the California Facility Treatment Center. Why? Because she can't smoke cigarettes.

In an interview on Wednesday, Michael Lohan revealed his daughter had lost interest in Seafield because they won't let her smoke.

"It is come to my attention that Lindsay does not want to go to Seafield in New York because it's not private enough, they don't allow smoking and the accommodations are not suitable to her needs," he said.

But luckily, he said the venue, located in a wealthy enclave by the sea, has made an exception for Lindsay and promised to allow his daughter to smoke cigarettes "even though they have a no smoking policy."

On the eve of her sixth stint in treatment, her brother Michael Junior made the last-ditch effort to the City Attorneys for L.A. to have them sign off on The Lukens Institute in Florida instead of the California location for the court-ordered 90-day treatment.

 "Lindsay wants to be in the Florida center, but she isn't sure if she's going to be able to make that happen. She's in a panic about her situation."

As of last Wednesday, there were three options on the table for Lindsay: California-based Morningside Recovery, Seafield Center in New York's Westhampton Beach, and Lukens, a luxury center based in Palm Beach Gardens, Florida.

The actress' lawyer, Mark Heller, never responded to the choice and now it's too late; courts made the decision for the troubled star.

As RadarOnline.com previously reported, LiLo's dad, Michael, has been lobbying for Lukens, which bills itself as providing "sophisticated treatment for sophisticated clients in a setting that meets the highest standards of luxury."
