Lesbian Couple Can’t Cohabitate: Issue with Morality?
A North Texan Lesbian couple can't cohabitate, as ruled by a judge. Apparently, the lesbian couple can't cohabitate because of a morality clause included in the divorce papers of one of the women.
The morality clause which is the reason why the lesbian couple can't cohabitate is commonly found in the divorce papers in Texas and in other states. The clause prevents a divorced parent from having a lover to spend the night while the kids are at home. Moreover, if the couple decided to marry, it can exempt them from the legal provision of the divorce papers. However, marriage for gay couples is not an option in the state of Texas because it is not recognized legally.
Reportedly the terms of the 2011 divorce papers are enforced during the hearing for Carolyn and Joshua Compton by the Collin County District, John Roach Jr. Thus, he ordered Carolyn Compton's romantic partner, Page Price, to move out of the house the lesbian couple is sharing with Compton's two daughters (10 yrs old and 13 yrs old.) Judge Roach allowed Price 30 days to look for another place to reside in.
Joshua Compton wanted the morality clause to be imposed for the benefits of his children, as stated by his lawyer, Paul Key. Carolyn and Joshua Compton were married for 11 years before the breakup happened. Carolyn filed for divorce in September 2010.
The judge has mentioned that the morality clause does not specifically target same-sex couples and the language used in writing is gender neutral. "It is a general provision for the benefit of the children," Roach has stated.
On the other hand, the lesbian couple said that they deemed the clause as unconstitutional. However, the two are willing to comply with the judge rulings but they also believe that it will have an adverse effect to the family. "It will be disruptive to their family and has the potential of being harmful to the children," the pair said in the statement. The lesbian couple is still considering if they will file an appeal or not.
