Charlie Sheen Lost Custody Battle For His 4-year Old Twins, For Now At Least – Bob And Max Will Return To Their Mother’s Home After Denise Richards Withdrew Her Guardianship

Soon after former Bond girl Denise Richards and Charlie Sheen's ex-wife wrote a letter to Los Angeles County Department of Children and Family Services, announcing her decision to withdraw herself from taking temporary custody to the kids, the government agency tried to change her mind.

DCFS Medical Director Dr. Charles Sophy arranged a special arbitration with Richards and Mueller last Thursday to convince Richards to stay on board while the agency continue their attempt to steadily "reunify" the kids with their mom, Brooke Mueller, unfortunately the efforts were not successful, according to TMZ.com.

Charlie Sheen, the father of the twins Bob and Max, was hoping that DCFS could clear things up with Richards but the actor felt that the government agency already "burned that bridge," a reliable source told The News.

On that note, the court awarded Scott Mueller, Brooke Mueller's brother whose a father of two children himself, with the temporary custody to Charlie Sheen's twins.

The twins will be moving out of Denise Richards' home by the end of Friday and will go back to Brooke Mueller's house where Scott agreed to stay to be able to take care of the kids, as TMZ.com reported.

No statement was made though, whether Brooke will be staying in the same house with the kids full-time.

Sheen bought Brooke Mueller's house for the twins to live in during the time that they were still living with their mom.

Denise Richards had been taking care of the 4-year old twins in her gated house nearby since early May when Brooke was sent to the hospital because of substance abuse.

The former Bond girl, who has two daughters with Sheen, informed DCFS officials that she wanted to withdraw her guardianship to the boys because Mueller was reportedly blocking her attempts in getting professional help for the twins who were acting violently, according to the letter sent by Richards herself.

A source told The News that Sheen trusts that the boys may be suffering from undiagnosed fetal alcohol syndrome and that Brooke's resistance to an assessment was enough reason to consider that the children's lives are in danger.

 "He wants to push DCFS to have the boys evaluated by a psychiatrist. He wants an intervention," the insider said. "Brooke says she doesn't want anything that might lead to medication, but the real reason she doesn't want this, in my opinion, is that it would expose her actions."

"Scott has formally notified Charlie Sheen's lawyer he wants $55,000 in child support because he has been appointed Bob and Max's temporary guardian," the source revealed. "He expects to be paid, immediately, even though Charlie already pays for all of the boys expenses including their pre-school, doctors visits, etc. During the time that Denise Richards was their guardian, she didn't ask Charlie for one dime in child support, she actually turned it down."

The source claims that Sheen did consider asking his parents, Martin Sheen,73, and Jean Templeton - even his brother Ramon Estevez, 50, to take temporary custody of the kids.

Brooke Mueller was not able to defend herself from the allegations being thrown at her because she has to abide the gag order issued by the judge, a source close to the Mueller's revealed.
