Kanye West Sued For ‘Gold Digger’ Sample Of Obscure 1974 Single; Accusers Asking For “Millions”

Kanye West has been sued by the family of David Pryor for allegedly sampling Pryor's song "Bumpin' Bus Stop" for West's 2005 No. 1 hit "Gold Digger."

David Pryor as a member of the group Thunder & Lightning released "Bumpin' Bus Stop' in 1974, and it remained an obscure song for many years.

Trena Steward and Lorenzo Pryor, the children of David Pryor, claim that Kanye West took a 13-second part of the song in which their father says "get down" as an echo of West's chorus, "Get down girl, go 'head, get down," according to TMZ.

The pair each own a quarter of their father's song, and they have asked the judge to stop sales of "Gold Digger," an odd request since the song has been out for 8 years already. They are also asking for "millions of dollars" in damages for the unlicensed sample, MTV News reported.

They also claim that the defendants named in the case have "systematically and willfully refused to clear samples of the Plaintiffs' original, copyrighted work in order to gain a commercial profit and to avoid paying and crediting the author."

The copyright/RICO lawsuit claims that Kanye West and his labels engaged in a 15-year long "illegal copyright infringement scheme and criminal enterprise involving the unauthorized, willful sampling of plaintiffs original copyrighted music on a massive scale."

The labels named in the lawsuit include Roc-a-Fella Records, Bad Boy Records, Stones Throw Records, Bomb Hip-Hop Records, Autumn Games, Activision, Caroline Distribution and The Island Def Jam Music Group.

Kanye West and his representatives haven't yet commented on the allegations.
