In September 2008, Ullyot was hired as the general counsel to Facebook. At the time, the site had more than 100 million members and was valued at $15 billion. His job was and still is to deal with and address the complicated privacy issues that Facebook entails due to its wealth of user data.

He also was general counsel for Facebook to a patent fight with Yahoo to investor disgruntlement around its initial public offering.

He built up the team from 10 when Facebook was a startup to more than 70 as a public company. In that time, Facebook has grown from 500 people to 5,000 and from 100 million to over one billion active users.

During his time with Facebook, he defeated the Winklevoss twins after their initial victory over Facebook co-founder Mark Zuckerberg. Ted Ullyot settled with Yahoo during that case.
