Amanda Bynes' Parents Battle For Conservatorship, But New York Laws Hinder Process

With Amanda Bynes slowly spiraling on Twitter and in public, parents Rick and Lynn Bynes' efforts to seek conservatorship, like Britney Spears with her father, is proving challenging due to Bynes' New York residence.

According to Radar Online, while Bynes' worried parents would seek a conservatorship in California, in New York, it is considered a guardianship, which is more difficult to obtain.

"Amanda's parents have been told it's much harder for them to get guardianship of their adult daughter in New York than if they were to have the proceedings take place in California," says a source.

"Under New York law, Amanda could have the option of having a jury of her peers decide if she was in need of having her parents take control of her life. In the California courts, a judge signs off on the conservatorship."

But even a conservatorship is not an easy thing for the 27-year-old's concerned parents to obtain.

"Conservatorships are very hard to get, and being mentally ill and addicted to drugs isn't enough," the source continues.

"Amanda hasn't ever been to rehab, or ever agreed to see mental health professional. Her parents are absolutely powerless to do anything at this point."

Under the New York state Mental Hygiene Law Article, 81, a family member typically files to be appointed guardian, and Amanda Bynes is called an "Alleged Incapacitated Person," until a court evaluator meets with her. While the petition is pending, the judge can appoint a temporary guardian who can be given authority over the person's needs and finances.

But Bynes' parents swear it has nothing to do with money.

"They wouldn't want to be paid for their services, and this absolutely isn't about getting access to Amanda's money," says the source.

As previously reported, Rick and Lynn fear schizophrenia for their troubled daughter.
