Katherine Heigle Broke Bad on Duane Reade; Grey's Anatomy Star Sues Duane Reade for $6 Million for Running Pictures of Her Shopping; This Keeps Katherine Heigl Up at Night, Pass the NyQuil

Katherine Heigl Broke? The former "Grey's Anatomy" star has filed a $6 million civil lawsuit against Duane Reade for using her name and an unauthorized paparazzi photograph of her in its commercial advertising. 


The drug store chain posted pictures of the "Grey's Anatomy" actress while she was doing personal shopping. Daune Reade reportedly tweeted that picture with the caption, "Love a quick #DuaneReade run? Even @KatieHeigl can't resist shopping #NYC's favorite drugstore." Katherine Heigl broke bad on Duane Reade. 


Recently the media has also been reporting that Katherine Heigl is broke. Katherine Heigl's lawyer Peter Haviland stated, "We expect Duane Reade to pay for its willful misuse of Katherine Heigl's name and likeness."


Katherine Heigl sued the Duane Reade for $6 million because the chain posted a paparazzi picture on Twitter and Facebook. The Emmy-award winning actress says Duane Reade Inc., is using the picture of her leaving a New York City branch of the drugstore chain in its promotional materials.


Katherine Heigl says Duane Reade violated her rights. The 35-year-old actress who starred in the films "Knocked Up" and "27 Dresses" filed the lawsuit on Wednesday in federal court in Manhattan. Heigl's suit charges that the photo was also used on Duane Reade's Facebook account to "imply falsely that Plaintiff endorses Defendant."


Heigl says Duane Reade wrongfully tried to profit off the pictures by distributing them alongside promotional slogans on its official Facebook and Twitter accounts without her "knowledge or approval." The lawsuit says the company is exploiting the actress' image for commercial gain despite her objection.


The complaint, made public by the New York Daily News, reads in part, "The Heigl photograph is a typical 'paparazzi' shot, depicting plaintiff walking on the street in New York City, in a private moment looking away from the camera. Use of plaintiff's image under these circumstances improperly exploited plaintiff's name and likeness, as a celebrity, for defendant's commercial advertising and purposes of trade, without authorization."


The complaint says Heigl would donate any money she receives from the suit to the Jason Debus Heigl Foundation, which helps find homes for dogs.


Katherine Heigl recently did a voice the animated movie "The Nut Job." She hits the screens next in "North of Hell" with Patrick Wilson and "Jenny's Wedding" with Alexis Bledel and Tom Wilkinson.
