According to documents obtained by Radar Online, Lindsay Lohan was served during the Christmas and New Year holidays but she never sent her reply which forced the court to find her in default.

Instead, she told the court through her lawyers: "I have been overwhelmed since leaving rehab and dealing with my sobriety and a miscarriage."

The sympathetic judge approved her petition for more time.

However, DNAM industries lawyers petitioned the court for a chance to cross-examine her over the said Lindsay Lohan scandal 2014 despite her plea to refrain from being questioned about personal issues since it invades her right of privacy and won't really impact on the ruling of the court.

The company in its petition wants to know "why she waited over five months" before responding to the court when during that period she was seen partying at Coachella music fest, appear on a late night show with David Letterman, guest star in a CBS sitcom, film her self-titled docu-reality show, and flew to London, as well as "engage in other conduct easily discoverable on the internet."
