Teresa Giudice Will Not Let Joe And Melissa Gorga Take Children; Will Have My Kids 'Over My Dead Body' Says Real Housewives Of New Jersey Star If Sent TO Prison On Fraud Ch[REPORT]

Real Housewives of New Jersey stars Teresa and Joe Guidice are in danger of going to jail for up to 50 years. Teresa's brother Joe Gorgas will most likely be in charge of taking care of their four small children, but Tesrea does not want that to happen and will fight to the death to see that her children go elsewhere.

Though Joe and Teresa have had major issues with Joe and wife Melisa Gorgas, their relationship seemed mended in recent episodes of The Real Housewives of New Jersey. It seems fitting that Teresa's closest family members will take the kids, but according to radaronline Teresa has publicly stated that Melissa will take her children 'over my dead body.' Teresa and Melissa have been fighting for several years and Teresa would not be able to watch her sworn enemy adopt her four little girls.

Although Teresa thinks that she won't be going to jail because a judge 'couldn't possibly take four children away from their mother' the possiblity of jailtime for the Jersey Housewife is very possible. 

 Real Housewife of New York CIty, Bethenny Frankel, has expressed her disapproval of the Giudices and is angry that they would risk losing their children for cash.

Bethenny says she feels no sympathy for the Giudices and thinks they are completely negligent for breaking the law in front on teh cameras. Thgouh Frankel feels no remorse for Teresa and Joe, she does feel bad for Teresa's four innocent daughters.

"My first thought today was, 'Oh, if they weren't on reality TV, none of this would probably ever be exposed.' And it's just funny how certain people are [like a] moth to a flame. It's almost like -- not that you want to get caught -- but people who love to be in the spotlight often have a lot of skeletons in their closet. It's just an interesting thing."

"I haven't paid that much attention," Frankel explained of the Giudice's legal woes. "Do I feel sorry for them? No, I don't. Not so much, because it broke the law. You broke the law and you went on television. That's not really that smart."

But Frankel, a mother herself, does feel bad for Teresa's four daughters:

"I feel badly for them because they have kids," she explained, "and their kids didn't sign up for this." 

Teresa and Joe Giudice are not just having legal problems, but they could also loose their reality show, The Real Housewives Of New Jersey. Though Bravo thrives on drama, the kind of spectacle surrounding Teresa and Joe is not positive and Bravo is becoming fed up with Giudice antics.

Bravo executives are debating the future of "The Real Housewives of New Jersey," on which Teresa is the focal pint of the drama. The bad publicity by Teresa and husband Joe has been a nuisance for the Network.

Bravo may also have to get involved with Giudice legal woes.

"Employees filming for Bravo can certainly be called as witnesses to establish that the Giudices were perhaps making large purchases in cash during the time of the bankruptcy," New Jersey-based attorney Darren Del Sardo explained. "The network could also be called as a witness to support an increase of anticipated income paid by Bravo to Teresa that was not disclosed in her bankruptcy filing. In addition, they could be asked questions regarding the Giudices' business operations that Bravo followed at the time of the filing."

The Giudices were charged with a whopping 39 counts of fraud. They included bank fraud, bankruptcy fraud, and conspiracy to commit mail and wire fraud. Joe is also accused of failing to file tax returns for 2004 through 2008.

The Giudices, who live in Montville Township, N.J., are facing charges of exaggerating their income while applying for loans before their reality TV show debuted.

Joe Giudice, 43, was released on a $500,000 bond secured by his father, Frank. Teresa Giudice, 41, was released on a $500,000 unsecured bond.

The duo also had their travel restricted to New Jersey and New York and had to surrender their passports.

The pattern of alleged fraud may have lasted a decade, ," U.S. Attorney Paul Fishman said.

"They're serious charges," he said.

 "They are alleged to have made false statements to the bankruptcy court and the banks that lent them money," Fishman told press.

They also failed to file tax returns from 2004-2008.

In a statement, Teresa Giudice discussed the charges.

"I support Joe and, as a wonderful husband and father, I know he wants only the best for our lovely daughters and me," she said. "I am committed to my family and intend to maintain our lives in the best way possible, which includes continuing my career. As a result, I am hopeful that we will resolve this matter with the government as quickly as possible."

The couple have plead not guilty to the charges and will apear in court on Oct. 8th.
