Gregg Allman's lawyer criticized the decision to include the musician in a wrongful death lawsuit filed against the producers of the Gregg Allman biopic "Midnight Rider." Gregg Allman and the producers of 'Midnight Rider' were  sued over a crewmember's death in a Georgia train crash. Sarah Jones, 27, who was working on the Gregg Allman biopic "Midnight Rider" died during shooting.

In a prepared statement, Atlanta attorney David Long-Daniels said "Mr. Allman simply provided an option to acquire motion picture rights to his life story and his autobiography." 

Long-Daniels said Allman had input into the script, casting and music of the film "Midnight Rider," but "had no role in securing any location for the making of the movie or the actual physical production of the film." The parents of Sarah Jones sued 10 individuals, including director Randall Miller, and eight corporations, including CSX Transportation, which owns the railroad tracks where Feb. 20 tragedy took place, Film Allman and Unclaimed Freight Productions. Singer Gregg Allman was sued along with others accused of being responsible for the February death of the young camera assistant.

Speaking about Allman, Jones family lawyer Jeffrey R. Harris said in an interview Thursday "He has legal responsibility for what happens on the shoot ... He, at least on paper, is a member of the management structure of the film."

Long-Daniels said "It is undisputed from the testimony at the recent court hearing that Mr. Allman and his representative did not have any knowledge that 'live people (would be) on a live track.' My clients were not at the location when this tragedy occurred nor have they ever been to that location. In fact, they had no role in securing any location for the making of the movie or the actual physical production of the film. They provided creative input on the script and the rights about Mr. Allman's life, and consulted about casting and music."

The Jones family is seeking unspecified damages for her death and pain and suffering, as well as punitive damages.

The report said: "In fact, the Midnight Rider defendants falsely informed, or gave the impression to, the cast and crew, including Sarah, that they had received permission to conduct filming on the railroad tracks."

The film "Midnight Rider" is based on legendary rocker Gregg Allman's memoir. Weeks ago, Allman recently settled a lawsuit with producers designed to stop director Randall Miller from continuing with the film after a train killed camera assistant Sarah Jones while working on the project in southeast Georgia. The accident cast doubts on the safety precautions taken by the filmmakers.

Weeks ago, Singer Gregg Allman wrote an open letter to director Randall Miller. The lawsuit, which was filed last, week says producers have told Allman's representatives they intend to revive the project despite the singer's objections. A spokeswoman for the producers said Monday they had no comment.

Second camera assistant Sarah Jones was killed near Jessup, Georgia during the first day of shooting "Midnight Rider," The day's shoot was of a dream sequence on a railroad trestle, with a hospital bed on the tracks. Jones was killed when a train came across the bridge. The crew was hit was debris. Jones was knocked into the path of the train by debris from the bed.

William Hurt, director Randall Miller and the production's still photographer tried to get the bed off the tracks but did not have time. Cameras were rolling as the train approached the bridge. It looks like the Midnight Rider production did not follow the safety procedures typical of a film shoot that has the cooperation of the railroad. Wayne County Sheriff's Department is conducting a homicide investigation.  The Sheriff's office impounded the digital camera.

William Hurt, who was set to play Gregg Allman in the film, dropped out of shooting last month.

Besides working on Midnight Rider, Sarah Jones was also a crewmember on "The Vampire Diaries."

The Hollywood Report wrote that the Midnight Rider production may not have been given proper permission to shoot. CSX railroad may not have given permission to "Midnight Rider" to be on its property.
